SUMMARIZED MINUTES

SPECIAL COUNCIL MEETING

 

October 14, 2008

5:00 p.m.

 

A meeting of the Flagstaff City Council was held on October 14, 2008 convening at 5:09 p.m., in the Council Chambers at City Hall, 211 West Aspen Avenue, Flagstaff, Arizona.

 

CALL TO ORDER

 

The meeting was called to order by Mayor Presler

 

1.      PLEDGE OF ALLEGIANCE, READING OF THE MISSION STATEMENT, AND INVOCATION

 

Mayor Presler asked those present to stand for the Pledge of Allegiance, the reading of the Mission Statement, and the Invocation.

 

2.      ROLL CALL

 

On roll call, the following were present:

Vice Mayor White

Councilmember Brewster

Councilmember Evans, Excused

Councilmember Haughey

Councilmember Overton

Councilmember Swanson, Excused

 

 

Also present were:

 

 

City Manager, Kevin Burke

City Attorney, Patricia Boomsma

 

3.

Consideration of Stipulation for Entry of Order:  Facilitating infrastructure improvements (Presidio in the Pines development project).

 

 

RECOMMENDED ACTION:

Approve the Stipulation.

 

Michelle D’Andrea, Assistant City Attorney, reported that the surety company and the developer have been unable to come to an agreement on all aspects of the Stipulation and Entry of Order for the public infrastructure.

 

Legal counsel for the surety company will be unable to meet on the issue for approximately one week.  Two and a half full-time employees have been dedicated for two weeks to nurture the process and move all parties forward to reach consensus on the proposed stipulation.  City staff has made every effort to make themselves available for all meetings between the parties.

 

Richard Elsey, for the developer, stated that he strongly desires resolution and has been working with staff to that end.  It has been a problem getting the surety company to come to the table.

 

Councilmembers expressed their consternation that an agreement between all parties has not yet been reached, and restated their expectations that the matter be resolved quickly.

 

Councilmember Overton moved to table the item to October 21, 2008.  The motion was seconded by Councilmember Brewster and passed on unanimous vote.

 

4.

Adjournment of Special Council Meeting.

 

There being no further business to come before the Council, the Special Meeting was adjourned at 5:28 p.m.
