NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION:

 

 

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the City Council and to the general public that, at this regular meeting, the City Council may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38‑431.03(A)(3).

A.

Consideration of Minutes: Regular Council Meeting of January 2, 2007.

 

RECOMMENDED ACTION: Approve the Minutes as submitted/corrected.

 

5.      PUBLIC PARTICIPATION

 

 

Public Participation enables the public to address the Council about an item that is not on the agenda.  If you wish to address the Council during Public Participation, it is not necessary to fill out a comment card.

 

If you wish to address the Council at tonight's meeting on an item that is on the agenda, please complete a comment card and submit it to the recording clerk as soon as possible.  Your name will be called when it is your turn to speak.

 

You may address the Council up to three times throughout the meeting, including comments made during Public Participation.  Please limit your remarks to three minutes per item to allow everyone an opportunity to speak.

 

6.      CONSENT - GENERAL:

 

 

ALL MATTERS UNDER ‘CONSENT CALENDAR’ ARE CONSIDERED BY THE CITY COUNCIL TO BE ROUTINE AND WILL BE ENACTED BY ONE MOTION APPROVING THE RECOMMENDATIONS LISTED ON THE AGENDA.  UNLESS OTHERWISE INDICATED, EXPENDITURES APPROVED BY COUNCIL ARE BUDGETED ITEMS.

 

A.

Consideration of Authority to Increase Contract Amount:  Legal services for telecommunications.

 

 

RECOMMENDED ACTION:

Authorize an additional increase to Miller & Van Eaton, P.L.L.C., in the amount of $17,500.00.

 

7.      CONSENT – CONTRACTUAL

 

A.

Consideration of Bids:  Parks fencing.

 

 

RECOMMENDED ACTION:

Approve the bid from Buffalo Fencing Company in the amount of $24,390.64, plus applicable tax.

 

B.

Consideration of Bids:  Gateway and directional signs.

 

 

RECOMMENDED ACTION:

Approve the bid from F & N Enterprises, doing business as SmithCraft, and Northern Arizona Signs, in an amount not to exceed $97,200.00.

 

C.

Consideration of Bids:  Website for the Convention and Visitors Bureau.

 

 

RECOMMENDED ACTION:

Approve the bid from Carver Letcher Miller Incorporated, doing business as CLM Design in the amount of $30,948.50, plus a 10% contingency for unanticipated services.

 

D.

Consideration of Renewal of Out-of-City Water Use Agreement:  Mary’s Café.

 

 

RECOMMENDED ACTION:

Approve renewal of the out-of-city water use agreement with Mary’s Café.

 

E.

Consideration of Amendment to Agreement:  Dispatch services.

 

 

RECOMMENDED ACTION:

Approve the amendment to the agreement with Flagstaff Medical Center at a rate of $410.95 per day to the City.

 

F.

Consideration of Annual On-Call Service Agreements:  Engineering, surveying, geotechnical, architectural, and landscape architecture.

 

 

RECOMMENDED ACTION:

(1) Approve nineteen agreements, each not to exceed $250,000.00 per year, as follows:

 

 

 

 

(a)

Arizona Engineering Company; The WLB Group, Inc.; Shephard Wesnitzer, Inc.; Woodson Engineering & Surveying, Inc.; Plateau Engineering, Inc.; Carter & Burgess, Inc.; Turner Engineering, Inc.; and Rothberg Tamburini & Winsor, Inc., for engineering consulting services;

 

 

 

(b)

Arizona Engineering Company; Engineering and Environmental Consultants, Inc.; Turner Engineering, Inc.; Woodson Engineering  Surveying, Inc.; and Stantec Consulting, Inc., for surveying consulting services;

 

 

 

(c)

Ninyo & Moore, and Speedie & Associates, Inc., for geotechnical engineering consulting services.

 

 

 

(d)

Johnson Walzer Associates, LLC; and Stantec Consulting, Inc., for architectural engineering consulting services; and

 

 

 

(e)

Urban Earth Design; and Sherman Group, Inc., for  landscape architecture consulting services; and

 

 

 

2.

Authorize the City Manager to execute the necessary documents.

 

G.

Consideration of Intergovernmental Agreement:  Sustainable building program.

 

 

RECOMMENDED ACTION:

Approve the intergovernmental agreement with Coconino County in the amount of $25,000.00.

 

H.

Consideration of Intergovernmental Agreement:  Rural environment corps for joint fire activities.

 

 

RECOMMENDED ACTION:

Approve the intergovernmental agreement with Coconino County on the basis of in-kind payment through training, and/or project assistance on County land from the Flagstaff Fire Department fuel crew.

 

8.     BOARDS AND COMMISSIONS

 

No items were submitted.

 

9.      PUBLIC HEARINGS

 

A.

Consideration of Liquor License:  Sherrie Padilla, “Varsity Gasser”, 1020 So. Milton Rd., Series 10, New License.

 

RECOMMENDED ACTION:

Open the public hearing.

Receive citizen input.

Close the public hearing.

 

The City Council has the option to:

 

(1)

Forward the application to the State with a recommendation for approval;

 

(2)

Forward the application to the State with no recommendation; or

 

(3)

Forward the application to the State with a recommendation for denial based on the testimony received at the public hearing and/or other factors.

 

B.

Consideration of Resolution No. 2007-10:  A resolution of the City Council of the City of Flagstaff, Arizona (“City”), declaring as a public record “The Flagstaff Townsite Historic District Design Standards and Guidelines” (“FTHD Guidelines”).

 

RECOMMENDED ACTION:

Read Resolution No. 2007-10 by title only.

C.

Consideration of Public Hearing on Designation of  the Flagstaff Townsite Neighborhood District as an Historic Design Review Overly Zone and Consideration of Ordinance No. 2007-16:  An ordinance of the City Council of the City of Flagstaff, Arizona, designating the Flagstaff Townsite Neighborhood District as an Historic Design Review Overlay Zone (“THDRO”) with specific geographical boundaries as delineated on the attached map, and adopting by reference the Flagstaff Townsite Historic District Design Standards and Guidelines (“FTHD Guidelines”).

 

 

RECOMMENDED ACTION:

Open the public hearing.

Receive citizen input.

Close the public hearing.

Consideration of Resolution No. 2007-09:  A resolution of the City Council of the City of Flagstaff authorizing signatures for checks and payment vouchers.

D.

Consideration of Resolution No. 2007-11:  A resolution designating the document known as the “2007 Draft Amendments to the Land Development Code regarding the Recommendations of the Community Housing Policy Task Force” as a public record.

E.

Consideration of Resolution No. 2007-12:  A resolution of the City Council of the City of Flagstaff, Arizona, opposing the Divine Strake Project and any related testing at the Nevada Test Site.

11.    OTHER BUSINESS

 

A.

Consideration of Appointment:  Councilmember representative to the Coconino County Methamphetamine Task Force.

 

 

RECOMMENDED ACTION:

Discuss in Executive Session and make the appointment at the Council meeting.

 

B.

Consideration of Discussion and Possible Direction:   BBB Tax Advisory Task Force.

 

 

RECOMMENDED ACTION:

Discuss and provide direction on next steps.

 

C.

Reconsideration of Ordinance No. 2007-14:  An ordinance rezoning a total of approximately 6.69 acres of land located at 2650 So. Beulah Boulevard from UC, Urban Commercial District, Conditional (6.03 acres) and RR, Rural Residential District (.66 acres), to Urban Commercial District Conditional.

 

 

RECOMMENDED ACTION:

If the City Council wishes to reconsider this matter, a member of the previous prevailing vote should:

Move to reconsider Ordinance No. 2007-14.
