NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION:

 

 

Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the City Council and to the general public that, at this regular meeting, the City Council may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38‑431.03(A)(3).

Public Participation enables the public to address the Council about an item that is not on the agenda.  If you wish to address the Council during Public Participation, it is not necessary to fill out a comment card.

 

If you wish to address the Council at tonight's meeting on an item that is on the agenda, please complete a comment card and submit it to the recording clerk as soon as possible.  Your name will be called when it is your turn to speak.

 

You may address the Council up to three times throughout the meeting, including comments made during Public Participation.  Please limit your remarks to three minutes per item to allow everyone an opportunity to speak.

 

6.      CONSENT - GENERAL:

 

 

ALL MATTERS UNDER ‘CONSENT CALENDAR’ ARE CONSIDERED BY THE CITY COUNCIL TO BE ROUTINE AND WILL BE ENACTED BY ONE MOTION APPROVING THE RECOMMENDATIONS LISTED ON THE AGENDA.  UNLESS OTHERWISE INDICATED, EXPENDITURES APPROVED BY COUNCIL ARE BUDGETED ITEMS.

 

A.

Consideration of Sole Source Purchase:  Software bridge module for Firehouse software system.

 

 

RECOMMENDED ACTION:

Approve the purchase from ACS Government Systems in the amount of $15,000.00, plus applicable sales tax.

 

B.

Consideration of Increase in Expenditure Authority:  Document imaging.

 

 

RECOMMENDED ACTION:

Approve an increase in expenditure authority to DocUnited and ICM Imaging in the amount of $830.57 for sign permit related drawings.

 

C.

Consideration of Stipulated Judgment:  City of Flagstaff v. Eagle Crest Enterprises, L.L.C.

 

 

RECOMMENDED ACTION:

Authorize Ayers & Brown, P.C., to submit the Stipulated Judgment settling the condemnation action filed in Coconino County Superior Court for the acquisition of one fee simple interest and two temporary construction easements in the property described in the exhibits to the Stipulated Judgment for the public purpose of reconstructing and improving Fourth Street and relocating the BNSF railroad track.

 

7.      CONSENT – CONTRACTUAL

 

A.

Consideration of Bids:  Buffalo Park reclaimed water storage tank repairs, painting, and maintenance.

 

 

RECOMMENDED ACTION:

Reject the only bid received and rebid at a later date.

 

B.

Consideration of Grazing Lease:  Red Gap Ranch.

 

 

RECOMMENDED ACTION:

Approve the lease with Manterola Sheep Company, Inc., in the amount of $.03 per head per day.

 


C.

Consideration of Service Agreement:  Software upgrade services for the Police Department.

 

 

RECOMMENDED ACTION:

Approve the agreement with Intergraph Public Safety for the ILEADS 8.0 upgrade scope of work in the amount of $51,540.00, plus applicable taxes.

 

D.

Consideration of Service Agreement:  Route transfer study.

 

 

RECOMMENDED ACTION:

Approve the agreement with HDR, Inc., in the amount of $99,972.40.

 

8.     BOARDS AND COMMISSIONS

 

A.

Consideration of PC SUB 06-019:  A request for tentative plat approval by Thomas and Martha Pahler for the Litzler Multi-Family Subdivision, a planned development containing ten townhouse residential units on an approximately 1.69-acre parcel located at 3300 South Litzler Drive in the RMM-E, Multi-Family Residential District Established.

 

 

RECOMMENDED ACTION:

The Planning and Zoning Commission recommends approving the tentative plat with the conditions outlined in the staff summary and its attachments, and authorizing the Mayor to sign the final plat and City/Subdivider Agreement when notified by the Development Review Board that all conditions have been met and documents are ready for recording.

 

9.      PUBLIC HEARINGS

 

A.

Consideration of Liquor License Application:  Amanda Wilson, “Pasto”, 19 E. Aspen Avenue, Series 07, Person Transfer.

 

 

RECOMMENDED ACTION:

Open the public hearing.

Receive citizen input.

Close the public hearing.

 

The City Council has the option to:

 

 

 

(1)

Forward the application to the State with a recommendation for approval;

 

 

(2)

Forward the application to the State with no recommendation; or

 

 

(3)

Forward the application to the State with a recommendation for denial based on the testimony received at the public hearing and/or other factors.

 

B.

Consideration of Public Hearing:  “2007 Draft Amendments to the Land Development Code Regarding the Recommendations of the Community Housing Policy Task Force.”

 

 

RECOMMENDED ACTION:

Open the public hearing.

Receive citizen input.

Close the public hearing.

 

C.

Consideration of Ordinance No. 2007-20:  An ordinance adopting the “2007 Draft Amendments to the Land Development Code Regarding the Recommendations of the Community Housing Policy Task Force.”

 

 

RECOMMENDED ACTION:

Read Ordinance No. 2007-20 for the first time by title only.

 

D.

Consideration of Public Hearing (PC REZ 2006-003):  A request to rezone approximately 14.38 acres located at 644 North Locust Street from RR, Rural Residential, to UR, Urban Residential.

 

 

RECOMMENDED ACTION:

Open the public hearing.

Receive citizen input.

Close the public hearing.

 

10.    ORDINANCES AND RESOLUTIONS

 

A.

Consideration of Ordinance No. 2007-16:  An ordinance of the City Council of the City of Flagstaff, Arizona, designating the Flagstaff Townsite Neighborhood District as a Historic Design Review District, establishing the Townsite Historic Design Review Overlay Zone (“THDRO”) with specific geographical boundaries as delineated on the attached map, and adopting by reference the Flagstaff Townsite Historic District Design Standards and Guidelines (“FTHD Guidelines”).

 

 

RECOMMENDED ACTION:

Read Ordinance No. 2007-16 for the final time by title only.

Adopt Ordinance No. 2007-16.

 

B.

Consideration of Ordinance No. 2007-18:  An ordinance of the Mayor and Council of the City of Flagstaff, Arizona, amending Title 2 of the Flagstaff City Code by adding Chapter 2.21 entitled “Stormwater Advisory Committee”, for the purpose of codifying the Stormwater Advisory Committee, and clarifying its membership and quorum requirements.

 

 

RECOMMENDED ACTION:

Read Ordinance No. 2007-18 for the first time by title only.

 

C.

Consideration of Ordinance No. 2007-19:  An ordinance of the City of Flagstaff (“City”) repealing Ordinance No. 1847 pertaining to the assessment and recapture of costs for the water and sewer extensions under recapture districts, and replacing the same with new and more efficient provisions for water and sewer line extensions under reimbursement agreements.

 

 

RECOMMENDED ACTION:

Read Ordinance No. 2007-19 for the final time by title only.

Adopt Ordinance No. 2007-19.

 

D.

Consideration of Ordinance No. 2007-21:  An ordinance amending Chapter 2, Section 12 of the Flagstaff City Code for the purpose of changing the membership of the Flagstaff Traffic Commission, establishing advisory committees, and making additional minor changes in the wording of the chapter.

 

 

RECOMMENDED ACTION:

Read Ordinance No. 2007-21 for the first time by title only.

 

11.    OTHER BUSINESS

 

A.

Consideration of Discussion and Possible Direction Regarding Rules of Procedure for the Flagstaff City Council.

 

 

RECOMMENDED ACTION:

Discuss areas of priority for revisions to the Rules of Procedure.
