Transient Merchant License
Overview
The Flagstaff City Code contains several sections that govern the actions of transient merchants, peddlers, and solicitors. With some exceptions, a transient merchant, peddler, or solicitor is required to obtain a permit before he or she can conduct business.

Transient Business License Application
 
North Downtown Business District
All Merchants
 
This district is defined as all public property bounded by Route 66 on the south and Cherry Avenue on the north, Humphreys Street on the west, and Verde Street on the east. Any peddler operating in this area must apply for the following: 
  • Encroachment Permit, obtained through the City Engineering Department
  • Transaction Privilege (Sales) Tax License, obtained through the Tax, Licensing & Revenue Division of the City. The fees for this license are:                
    • $46 application fee
    • Deposit for City tax of $25 per day, not to exceed $200

Stationary Peddlers
In addition to the permits, a stationary peddler, defined as one who conducts business at a single location, must abide by the following: 
  • The location shall only be a City-approved site.
  • The merchant must maintain an unobstructed minimum sidewalk width of five feet.
  • The cart or stand used to display merchandise shall be completely self-contained in a single unit, including trash receptacles.
  • The merchant shall have signed, written consent from 100% of owners of directly competing businesses within a 145 foot radius.
  • The merchant shall have signed, written consent from 80% of all business owners within a 145 foot radius.

Mobile Peddlers

In addition to the permits, a mobile peddler, defined as one who conducts business while continuously moving along the sidewalk, must abide by the following:
  • The merchant must maintain an unobstructed minimum sidewalk width of five feet.
  • The cart or stand used to display merchandise shall be completely self-contained in a single unit, including trash receptacles.
  • The merchant shall not remain in one location more than 15 minutes during a one hour time period. Each relocation shall be 50 feet or greater from the previous location.

All Areas Outside the North Downtown Business District
If a person wishes to conduct business in a location other than the North Downtown Business District, the following is required: 
  • The merchant must obtain written permission from the property owner where he or she wishes to conduct business.
  • The merchant must apply for a Temporary Use Permit through the City Planning Department; this will generally require attending a Development Review Board meeting, held each Thursday.
  • After obtaining the Temporary Use Permit, apply for a Transaction Privilege (Sales) Tax License with the Tax, Licensing & Revenue Division of the City.
 
Licensing Requirements for Merchants Operating Outside North Downtown
Requirements for this license include the following: 
  • $46 application fee
  • Deposit for City tax of $25 per day, not to exceed $200
  • Photograph of the applicant
  • Description of motor vehicle, including the vehicle ID number (VIN)
  • Copy of the vehicle registration
  • Statement as to whether or not the applicant has been convicted of any crime, the nature of the offense, and the punishment or penalty assessed
  • Statement as to whether the applicant intends to use any signs advertising the merchandise
